By accessing or using Unkept ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Service

Unkept is a platform that tracks and documents public promises made by public figures including CEOs, politicians, and influencers. The Service includes a searchable database, user accounts, watchlists, voting features, and API access (for qualifying subscription tiers).

3. User Accounts

To access certain features, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain the security of your password and account
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

4. User Content

You may submit content to the Service, including promise submissions, comments, and votes ("User Content"). By submitting User Content, you:

Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content
Represent that you have the right to submit such content
Acknowledge that User Content may be reviewed, edited, or removed at our discretion

We do not claim ownership of your User Content, but we need these rights to operate the Service.

5. Prohibited Uses

You agree not to:

Submit false, misleading, or fabricated information
Impersonate any person or entity
Harass, abuse, or threaten other users
Use the Service for any unlawful purpose
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service or servers

6. Subscriptions and Payments

The Service offers free and paid subscription tiers. For paid subscriptions:

Payment is processed through Stripe
Subscriptions automatically renew unless cancelled
You may cancel at any time; access continues until the end of the billing period
Refunds are provided at our discretion
Prices may change with 30 days notice

7. Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by Unkept and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission. The Unkept name, logo, and branding are our trademarks.

8. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

While we strive for accuracy in tracking and verifying promises, we do not guarantee that all information is accurate, complete, or current. Our verdicts represent our assessment based on available evidence and should not be considered definitive legal or factual determinations. Users should independently verify information before relying on it for any purpose.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BROKENPROMISES.IO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Unkept and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting an update on the Service and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
